This agreement is between AllAustin.Com (Broker) and the
AllAustin.Com website visitor ("User") as entered in the name field
on the Registration Section below.
In consideration for services to be performed by Broker, User grants to Broker
the right to act as User's real estate agent under the following terms:
1. User has not signed any agreement with a real estate agent
or agency that would prevent User from entering into this Agreement with Broker
and, at the present time, User is not working with another real estate agent or
agency on a formal or informal basis;
2. User agrees to abide by all copyright restrictions placed
on the content of the AllAustin.Com site including, but not limited to, any
material or data compilations where the copyright is held by Broker or others;
3. User agrees that any electronic or printed copies of
property listings - or other content from this website, will be for User's sole
and exclusive use and that User will not attempt in any manner to
recommercialize, sell or otherwise distribute such materials;
4. User agrees that, unless otherwise agreed upon, Broker
will be compensated by the Management or Owner of the Property;
5. User agrees that Broker represents User as a
Buyer/Renter's Agent and that User is a client of Broker.
6. User agrees that Broker may also represent other
prospective renters seeking to lease properties that may meet User's criteria;
7. User agrees to avoid the use of profanity, expletives,
derogatory comments or any terms or phrases that discriminate based upon race,
color, sex, religion, handicap, familial status or national origin in any
communications on or through this website;
8. User agrees to use this Web site at his or her own risk.
If the use of this Web site or the materials therein results in the need for
servicing or replacing property, material, equipment or data, Broker is not
responsible for those costs;
9. User agrees that in no event shall Broker and/or its
suppliers be liable for any direct, indirect, incidental, special or
consequential damages arising out of or in any way connected with the use of
this web site or with the delay or inability to use this web site, or for any
information, products, and services obtained through this web site, or
otherwise arising out of the use of this web site, whether based on contract,
tort, strict liability or otherwise, even if Broker or any of its suppliers has
been advised of the possibility of damages;
10. User agrees that the information, software, products, and
services published on the allaustin.com site may include inaccuracies or
typographical errors. User understands that Broker is providing this site and
its contents on an "as is" basis without warranty of any kind. Broker
and/or its respective third-party providers reserve the right to modify the
contents of this site without notice;
11. User agrees that this Web site contains hyperlinks to Web
sites operated by parties other than Broker. For example, clicking on a
category in Links may bring you to a site operated by a party independent of
Broker. Such hyperlinks are provided for your reference only. Broker is not
responsible for their contents nor in any way does the hyperlink imply that
Broker endorses the material on such Web sites or any association with their
